Gag Clause Prohibition Compliance Attestation Amendment for Small Groups

New requirements have been added to the Consolidated Appropriations Act (CAA) relating to the disclosure of health care information. These requirements apply to groups active since Dec. 27, 2020, and prohibit restrictions on the disclosure of certain cost and quality information.
We will be distributing the appropriate contract amendments to BlueCross BlueShield of South Carolina small groups on Oct. 11, 2023. These will include the new gag clause prohibition compliance attestation amendment as well as the RxDC reporting amendment communicated to groups earlier this year.
- Level funded groups will receive an amendment acknowledging the updated Administrative Services Agreement. Groups will need to sign, date and return this amendment to BlueCross.
- ACA, chamber and legacy groups will receive an amendment based on their contract. Copies of amendments for these groups are linked here:
